Este artículo analiza la ética de gobierno como una cuestión de control horizontal entre los poderes del Estado. Dicha cuestión es abordada en términos del denominado control parlamentario, que en Argentina está condicionado por el poder del Presidente de la Nación de emitir decretos legislativos en casi todas las materias. Este poder de decreto es estudiado en relación a una polémica modificación de una la ley de vacunas aprobada por el Congreso Nacional en el contexto de la pandemia del COVID-19.

La obra del cantautor vallenato Máximo Jiménez se mantiene más vigente que nunca. Sus canciones poseen un valor testimonial y literario que aporta a la construcción de un relato plural de Colombia y que, por lo mismo, también permite cuestionar las narrativas hegemónicas de nuestra mitología nacional en torno al conflicto político, en la medida en que concreta la voluntad colectiva del campesinado por recordar y hacer memoria de sus procesos organizativos como agremiación, así como también de hacer frente (...) a problemáticas tales como la reforma agraria, la violencia política, el gamonalismo, la inercia y el abandono estatal y la desigual tenencia de tierras, especialmente en los departamentos de Córdoba y Sucre, a partir de finales de la década del sesenta, en el marco de las reivindicaciones de la agremiación conocida como la Asociación Nacional de Usuarios Campesinos (ANUC). De forma contraria a lo que aseguran algunos pensadores, como Walter Ong sobre las culturas orales, la música de Máximo Jiménez se sitúa de forma crítica y con honda sensibilidad histórica frente a la política colombiana y sus prácticas de poder, así como también frente al panorama geopolítico e internacional de la época. En esa medida, el presente trabajo realiza un análisis sociocrítico de las canciones de Máximo Jiménez, particularmente, focalizando su manera de comprender la noción de ‘Pueblo’ y en la manera en que sus canciones establecen una relación entre sus textos y los hechos sociales que le circundan. En este trabajo consideraremos la relación entre el monismo de la sustancia divina y el pluralismo de las partes del continuo en sus escritos metafísicos de 1675-76. Este es otro punto de vista de la relación general entre monismo-pluralismo considerada por Andreas Blank, aunque compatible con el suyo. Para mostrar esta relación, primero consideraremos el tratamiento acerca de lo máximo en el continuo, distinguiendo dos tipos y mostrando que uno de ellos no fue tratado con anterioridad. Segundo, analizaremos el (...) estatus ontológico de la materia, como una cosa existente actualmente –aunque no sustancial. In this article, we will present a number of technical results concerning Classical Logic, ST and related systems. Our main contribution consists in offering a novel identity criterion for logics in general and, therefore, for Classical Logic. In particular, we will firstly generalize the ST phenomenon, thereby obtaining a recursively defined hierarchy of strict-tolerant systems. Secondly, we will prove that the logics in this hierarchy are progressively more classical, although not entirely classical. We will claim that a logic is to (...) be identified with an infinite sequence of consequence relations holding between increasingly complex relata: formulae, inferences, metainferences, and so on. As a result, the present proposal allows not only to differentiate Classical Logic from ST, but also from other systems sharing with it their valid metainferences. Finally, we show how these results have interesting consequences for some topics in the philosophical logic literature, among them for the debate around Logical Pluralism. The reason being that the discussion concerning this topic is usually carried out employing a rivalry criterion for logics that will need to be modified in light of the present investigation, according to which two logics can be non-identical even if they share the same valid inferences. In some recent articles, Cobreros, Egré, Ripley, & van Rooij have defended the idea that abandoning transitivity may lead to a solution to the trouble caused by semantic paradoxes. For that purpose, they develop the Strict-Tolerant approach, which leads them to entertain a nontransitive theory of truth, where the structural rule of Cut is not generally valid. However, that Cut fails in general in the target theory of truth does not mean that there are not certain safe instances of Cut (...) involving semantic notions. In this article we intend to meet the challenge of answering how to regain all the safe instances of Cut, in the language of the theory, making essential use of a unary recovery operator. To fulfill this goal, we will work within the so-called Goodship Project, which suggests that in order to have nontrivial naïve theories it is sufficient to formulate the corresponding self-referential sentences with suitable biconditionals. Nevertheless, a secondary aim of this article is to propose a novel way to carry this project out, showing that the biconditionals in question can be totally classical. In the context of this article, these biconditionals will be essentially used in expressing the self-referential sentences and, thus, as a collateral result of our work we will prove that none of the recoveries expected of the target theory can be nontrivially achieved if self-reference is expressed through identities. To make the case for non-conceptualism, Heck draws on an apparent dichotomy between linguistic and iconic representations. According to Heck, whereas linguistic representations have conceptual content, the content of iconic representations is non-conceptual. Based on the case of cartographic systems, the authors criticize Heck’s dichotomous distinction. They argue that maps are composed of semantically arbitrary elements that play different syntactic roles. Based on this, they claim that maps have a predicative structure and convey conceptual content. Finally, the authors argue that, (...) despite their differences, maps and sentences can logically interact with each other through heterogeneous inferences. These considerations not only challenge the view that conceptual content and inferential processes necessarily involve linguistic representations; furthermore, they provide a new perspective for thinking about maps, their semantics and syntax, and their interaction with linguistic systems. Los cambios que se derivan de la Biotecnología y, concretamente, de la edición genómica, por un lado, ofrecen un enorme potencial para desarrollar nuevos conceptos, métodos y novedosas aplicaciones para los urgentes retos y necesidades de la sociedad. Por el otro lado, tales biotecnologías son percibidas como si tuvieran el potencial de desafiar y, a veces, desdibujar las actitudes, valores y modelos culturales de la propia sociedad. A tal reto no puede estar, obviamente, ajeno el Derecho en atención a los valores, intereses y derechos en conflicto. Si la pregunta que debemos nuevamente formularnos es qué es el hombre o qué es la naturaleza humana, el Derecho debe también ofrecer respuestas que permitan dar un sentido jurídico contemporáneo a tal esencia, preguntas que conectan directamente con el propio concepto jurídico de dignidad, no solo en cuanto valor ontológico del ser humano, sino también, recogiendo los términos explícitos del artículo 10.1 de nuestra Constitución, en cuanto fundamento del orden político y de la paz social. Past research showed that the ability to focus on one’s internal states positively correlates with the self-regulation of behavior in situations that are accompanied by somatic and/or physiological changes, such as emotions, physical workload, and decision-making. The analysis of moral oriented decision-making can be the first step for better understanding the legal reasoning carried on by the main players in the field, as lawyers are. For this reason, this study investigated the influence of the decision context and interoceptive manipulation on (...) the moral decision-making process in the legal field gathering the responses of two groups of lawyers. A total of 20 lawyers were randomly divided into an experimental group, which was explicitly required to focus the attention on its interoceptive correlates, and a control group, which only received the general instruction to perform the task. Both groups underwent a modified version of the Ultimatum Game, where are presented three different moral conditions and three different offers. Results highlighted a significant increase of Acceptance Rate in those offers that should be considered more equal than fair or unfair ones, associated with a general increase of Reaction Times in the equal offers. Furthermore, the interoceptive manipulation oriented the Lawyers toward a more self-centered decision. This study shows how individual, situational, contextual, and interoceptive factors may influence the moral decision-making of lawyers. Future research in the so-called Neurolaw field is needed to replicate and expand current findings. (shrink)

A metainference is usually understood as a pair consisting of a collection of inferences, called premises, and a single inference, called conclusion. In the last few years, much attention has been paid to the study of metainferences—and, in particular, to the question of what are the valid metainferences of a given logic. So far, however, this study has been done in quite a poor language. Our usual sequent calculi have no way to represent, e.g. negations, disjunctions or conjunctions of inferences. (...) In this paper we tackle this expressive issue. We assume some background sentential language as given and define what we call an inferential language, that is, a language whose atomic formulas are inferences. We provide a model-theoretic characterization of validity for this language—relative to some given characterization of validity for the background sentential language—and provide a proof-theoretic analysis of validity. We argue that our novel language has fruitful philosophical applications. Lastly, we generalize some of our definitions and results to arbitrary metainferential levels. (shrink)

Over recent years, various semantics have been proposed for dealing with updates in the setting of logic programs. The availability of different semantics naturally raises the question of which are most adequate to model updates. A systematic approach to face this question is to identify general principles against which such semantics could be evaluated. In this paper we motivate and introduce a new such principle the refined extension principle. Such principle is complied with by the stable model semantics for (single) (...) logic programs. It turns out that none of the existing semantics for logic program updates, even though generalisations of the stable model semantics, comply with this principle. For this reason, we define a refinement of the dynamic stable model semantics for Dynamic Logic Programs that complies with the principle. (shrink)

The relations between the majority and minorities in a democracy have been standardly viewed as the main subject matter of toleration: the majority should refrain from using its dominant position to interfere with some minorities’ practices or beliefs despite its dislike or disapproval of such practices or beliefs. Can the idea of toleration provide us with the necessary resources to understand and respond to the problems arising out of majority/minorities relations in a democracy? We reply in the negative and make (...) two main claims: first, that resorting to toleration is not enough to make sense of the problems deriving from the unequal participation of minorities in society, and, second, that it risks sanctioning the asymmetric relation between the majority and minorities informed by the negative judgement of the former towards some belief or practice of the latter. We suggest resorting instead to the idea of equal opacity respect for persons: all persons should be treated equally as moral agents, in accordance with their equally possessing the capacity for self-legislation, and as if they were opaque to our judgement for all those properties of theirs which exceed moral agency. Looking at the majority/minorities relations through such a lens enables us to understand (and appropriately respond to) what is problematic in such relations: the majority often fails to treat minorities as moral agents by failing to take their voices into account on an equal footing, by seeing them merely as recipients of certain provisions affecting them rather than their authors, and by considering them as legitimately exposed to the majority’s (negative) judgment. The purchase of our argument is illustrated by reference to two minorities whose treatment is paradigmatic of the problematic nature of majority/minorities relations across Europe: Muslims and Roma. In this paper we present a framework for the dynamic and automatic generation of novel knowledge obtained through a process of commonsense reasoning based on typicality-based concept combination. We exploit a recently introduced extension of a Description Logic of typicality able to combine prototypical descriptions of concepts in order to generate new prototypical concepts and deal with problem like the PET FISH (Osherson and Smith, 1981; Lieto & Pozzato, 2019). Intuitively, in the context of our application of this logic, the (...) overall pipeline of our system works as follows: given a goal expressed as a set of properties, if the knowledge base does not contain a concept able to fulfill all these properties, then our system looks for two concepts to recombine in order to extend the original knowledge based satisfy the goal. In this work we present a dynamical approach to quantum logics. By changing the standard formalism of quantum mechanics to allow non-Hermitian operators as generators of time evolution, we address the question of how can logics evolve in time. In this way, we describe formally how a non-Boolean algebra may become a Boolean one under certain conditions. We present some simple models which illustrate this transition and develop a new quantum logical formalism based in complex spectral resolutions, a notion that (...) we introduce in order to cope with the temporal aspect of the logical structure of quantum theory. Son muchas las personas que no se han conformado con vivir abosortas ante el espectáculo de "lo que acontece", y que han buscado atender esa necesidad (...) intrínseca de "ir más allá", esculpiendo horizontes que rompen los moldes de la facticidad e insinúan la existencia de un ser que traspasa las fronteras de la contingencia en la que, sin embargo, parecemos estar atrapados inevitablemente. Indagar en la esencia misma de la experiencia humana para hallar su sentido más profundo nos dota de libertad y de la posibilidad de trazar un camino real y verdadero de plenitud para, de este modo, dejar de caer en brazos del ciego azar del que no somos más que irónica expresión. Background: The research community has a mandate to discover effective treatments for neurodegenerative disorders. The ethics landscape surrounding this mandate is in a constant state of flux, and ongoing challenges place ever greater demands on investigators to be accountable to the public and to answer questions about the implications of their work for health care, society, and policy. Methods: We surveyed US-based investigators involved in neurodegenerative diseases research about how they value ethics-related issues, what motivates them to give consideration to (...) those issues, and the barriers to doing so. Using the NIH CRISP database we identified 1,034 researchers with relevant, active grants and invited them to complete an online questionnaire. We received 193 responses. We used exploratory factor analysis to transform individual survey questions into a smaller set of factors, and linear regression to understand the effect of key variables of interest on the factor scores. Results: Ethics-related issues clustered into two groups: research ethics and external influences. Heads of research groups viewed issues of research ethics to be more important than the other respondents. Concern about external influences was related to overall interest in ethics. Motivators clustered into five groups: ensuring public understanding, external forces, requirements, values, and press and public. Heads of research groups were more motivated to ensure public understanding of research than the other respondents. Barriers clustered into four groups: lack of resources, administrative burden, relevance to the research, and lack of interest. Perceived lack of ethics resources was a particular barrier for investigators working in drug discovery. Conclusions: The data suggest that senior level neuroscientists working in the field of neurodegeneration (ND), and drug discovery specifically, are motivated to consider ethics issues related to their work, but the perceived lack of ethics resources thwarts their efforts. With bioethics centres at more than 50% of the institutions at which these respondents reside, the neuroscience and bioethics communities appear to be disconnected. Dedicated ethical, legal and social implications (ELSI) programs, such as those fully integrated into genetics and regenerative medicine, provide models for achieving meaningful partnerships not yet adequately realized for scholars and trainees interested in drug discovery for ND. Perú es indiscutiblemente un país multilingüe, con 48 lenguas habladas en diferentes grados de uso y dominio. En Ayacucho, uno de los departamentos de Perú, se hablan tanto el quechua como el español, lo que resulta en un alto grado de bilingüismo en la población. El objetivo de este estudio fue analizar la estrategia de la gramática contrastiva quechua-castellano en los niveles fonológicos, morfológicos, sintácticos y semánticos en la población de Ayacucho. Para ello, se adoptó un enfoque cualitativo y se (...) utilizaron técnicas de entrevista y revisión documental. Los resultados indican que la gramática contrastiva entre el quechua y el castellano a nivel fonológico, morfológico, sintáctico y semántico es altamente efectiva para el aprendizaje tanto de la primera como de la segunda lengua. The aim of this article is to amend some misunderstandings about Franz Brentano's thesis of intentionality, defending a different interpretation from the current one about the nature of intentional object and intentional correlate, and proposing an analysis of the origin of this conceptual confusion. The main problem lies in his student Anton Marty's interpretation of the immanent object, paving the way for an immanentist reading of Brentano's theory of intentionality.

Since the advent of drug regulation in 1962, regulatory agencies have been in the practice of using strict standards to test the safety and efficacy of medical treatments and products. Regulatory agencies, such as the FDA, demand two full-fledged Randomized Clinical Trials demonstrating the safety and effectiveness of drugs to grant its marketing authorization. On the contrary, surgical treatments are left completely unregulated. There are several reasons explaining this difference, and all of them point to the difficulty of conducting well-designed (...) RCTs in surgery. However, we argue that none of these arguments is decisive and that, under certain conditions, surgical RCTs can be morally justified and methodologically sound. Although ethical constraints restrict the number of testable surgical procedures, and surgical trials might not be as dependable as pharmaceutical RCTs, our analysis suggests that, in certain cases, it is possible to obtain high-quality evidence about the safety and efficacy of surgical procedures. Untested surgical treatments may prove to be ineffective and harm patients. Therefore, regulation of surgical procedures seems not only morally acceptable and able to provide reliable scientific evidence, but also desirable and justified from an ethical-political standpoint. Millones de personas en el mundo no disponen de otra alternativa para huir de la pobreza más extrema que trabajar en condiciones de explotación en una sweatshop. A través de la non worseness-claim y el argumento de la elección, Powell y Zwolinski sostienen que, aunque dicha explotación sea moralmente problemática, proporciona beneficios a dichas personas que impediría considerarla gravemente injusta y justificar así la prohibición o regulación de las sweatshops. En este trabajo se analizan las claves de este discurso, así (...) como los principales intentos de rebatirlo basados en la idea de que dichas fábricas se aprovechan de injusticias de trasfondo de las que los empresarios son, de algún modo, responsables. El éxito de este argumento exige asignar a los empresarios responsabilidades distributivas adicionales a las generales que resulta, sin embargo, cuestionable. De ahí que, en la parte final del trabajo, ofrezca algunas razones alternativas para considerar que la explotación en las sweatshops es una injusticia grave que justifica su regulación. (shrink)

El autor de este artí-culo, que ya ha publicado con ante-rioridad otros dedicados a la misma temática, expone aquí la legisla-ción general de la Iglesia sobre este delicado y complejo tema, que tanta repercusión ha tenido y está teniendo en la actualidad: describe el cambio de actitud de la Iglesia cató-lica frente a estos comportamientos delictivos de sus clérigos y religiosos, y analiza los cambios operados tanto en la legislación general de la Iglesia como en las disposiciones reciente-mente adoptadas por (...) algunas Confe-rencias Episcopales para responder más eficaz y rápidamente ante estas dolorosas situaciones. Las medidas adoptadas por la Iglesia abarcan tres grandes campos: el de la preven-ción de estas situaciones mediante la debida formación y selección de los candidatos, atención a sus nece-sidades, formación permanente, etc. (shrink)

In this article I explore some topics of the philosophy of law of Julius Binder. More specifically, I explore the relation and compatibility of his ideas with national-socialism. In the first part of the article I analyze the neo- Kantian approach underlying to his philosophy. Subsequently I analyze his turn towards neo- Hegelianism. In the last sections I address the philosophical concept of nation that this author defended and I search for its links with both national- socialism and Hegelian philosophy. (...) La guerra no es una actividad necesariamente sangrienta, pero sí necesariamente política. Esta, en tanto que actividad del espíritu y sentimiento, anida en las mentes de quienes toman parte en ella. En el mundo del siglo XXI el incremento de relaciones e intereses compartidos hace difícil que las guerras puedan ser totales; lo que existe es una zona gris en la que se plasma la rivalidad de los diferentes actores en planos concretos. Narrativas e imágenes son fundamentales como herramientas de (...) persuasión política. En este sentido también son elementos del _Soft Power_, entre ellas la Historia, que puede ser instrumentada como la mejor de las narrativas. Estas permiten controlar la agenda informativa y, a su vez, la realidad, así como crear los sobreentendidos que sirven a las Relaciones Internacionales y ayudan a la implementación de las políticas. El dominio cultural y, sobre todo, la cinematografía son elementos claves en tal propósito, porque no importan los hechos tanto como su percepción, su memoria y recuerdo. (shrink)

This book reports on theoretical and practical analyses of the ethical challenges connected to driving automation. It also aims at discussing issues that have arisen from the European Commission 2020 report “Ethics of Connected and Automated Vehicles. Recommendations on Road Safety, Privacy, Fairness, Explainability and Responsibility”. Gathering contributions by philosophers, social scientists, mechanical engineers, and UI designers, the book discusses key ethical concerns relating to responsibility and personal autonomy, privacy, safety, and cybersecurity, as well as explainability and human-machine interaction. On the other hand, it proposes practical strategies to face the most urgent ethical problems, showing how the integration of ethics and technology can be achieved through design practices.
